Fines for violations

Article IV, Section of the Indian Oaks Covenants, Conditions and Restrictions gives the Board of Directors the power to assess fines to compel homeowners to comply with the Deed Restrictions created in our Covenants, Conditions and Restrictions.

Chapter 209 of the Texas Property Code was amended to clarify homeowners' right to a hearing before the Board of Directors for fines assessed for violations of the Covenants, Conditions and Restrictions. If you have been fined, you may request a hearing by email, or by US Mail to:

general categories of fines

General categories of the Restrictions are paraphrased below, with links to the procedures and fines for violations.


  • Lots can only be used for single family residences. (Section 1)
  • Nothing can be built within 25 feet of your front property line or within 5 feet of the side or rear property lines. (Section 2)
  • Only one “out building” is allowed on a lot and it can’t be bigger than 600 square feet. (Section 3)
  • No business can be conducted on or in a lot unless it is 100% inside your house, and there can’t be any telltale signs of a business at all. (Section 4)
  • You can’t put up signs, except a For Sale sign, political signs, or garage sale signs. (Section 6)
  • You can’t do anything that would increase or cancel yours or your neighbor’s insurance. (Section 7)
  • Pets are ok on leashes but, no more than four per household. No breeding and no chronic barking allowed. (Section 8)
  • You can’t keep trash or debris on your property, and you need to keep trash cans out of sight. (Section 9)
  • Fences can’t be more than 6’6” tall and they must be nice. If you are on the water, no more than 4’ tall and chain link only. (Section 10) 
  • Trailers, sheds, etc. can’t be used as a residence, even temporarily. (Section 11)
  • If you start a construction project, it must be finished in 6 months. (Section 12)
  • Trailers, tents and the like can’t be used as a residence. (Section 13)
  • Boats, campers and so forth can’t be parked in the driveway. If they’re not in the driveway they still can’t be within 25 feet of the street, and no junk cars at all. (Section 14)
  • You can’t put up a prefabricated or old used structure at all. (Section 15)
  • You can’t do anything illegal or noxious. (Section 16)
  • You’ve got to keep the lawn looking nice. No weeds. Keep it trimmed. (Section 17)
  • If you don’t mow, the HOA can do it for you and charge you for it. (Section 18)
  • There are rules about storing fuel and how much you can store. (Section 19)
  • No hunting or shooting guns. (Section 20)
  • No antennas higher than 30 feet. (Section 21)
  • No dangerous chemicals (Section 22)
  • Flagpoles can’t be higher than 16 feet and you can only put up certain kinds of flags. (Section 23)
  • No discrimination. (Section 24)
  • You can’t build anything on the common areas. (Section 25)
